1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Bei Hu Properties LLC, doing business as "Luxora Living" ("Company," "we," "us," or "our"), governing your access to and use of the Luxora Living website, booking platform, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

Certain features of our Services require you to create an account. When you register, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information to keep it accurate and complete.
  • Keep your account credentials confidential and not share them with any third party.
  • Notify us immediately of any unauthorized access to or use of your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if you violate these Terms.

4. Booking and Reservation Terms

4.1 Reservations

When you make a reservation through our website, you are submitting a request to reserve a specific room or unit for the dates and terms indicated. A reservation is not confirmed until you receive a written confirmation from us, which may be sent via email or displayed on our platform. All reservations are subject to availability and our approval.

4.2 Pricing and Payments

All prices displayed on our website are in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, fees, or utility charges unless explicitly stated. Payment is processed securely through our third-party payment provider, Stripe. By providing payment information, you authorize us to charge the applicable amounts to your designated payment method.

4.3 Cancellation and Refund Policy

In compliance with California law, bookings made 72 or more hours before the scheduled check-in date are eligible for a free full refund within 24 hours of booking. Your card is pre-authorized at booking and charged only after the 24-hour cancellation window has passed. Bookings made less than 72 hours before check-in are charged immediately upon confirmation and are not eligible for the free cancellation window. Refunds, if applicable, will be processed to the original payment method. We reserve the right to cancel a reservation if we determine that the reservation was made in error, through fraudulent means, or in violation of these Terms.

4.4 Security Deposits

Certain reservations may require a security deposit. Security deposits are handled in accordance with California Civil Code Sections 1950.5 through 1950.7, which govern the collection, holding, and return of security deposits for residential rental properties. The deposit amount, conditions for deductions, and refund timeline will be disclosed prior to booking.

5. Property Rules and Tenant Obligations

As a guest or tenant at any Luxora Living property, you agree to:

  • Comply with all property rules, house guidelines, and community standards provided at the time of booking or check-in.
  • Use the premises solely for lawful residential purposes.
  • Maintain the property in good condition and promptly report any damage or maintenance needs.
  • Refrain from engaging in activities that disturb other residents or neighbors.
  • Not sublease, assign, or transfer your reservation or tenancy without our prior written consent.
  • Comply with all applicable local, state, and federal laws and regulations, including the City of Los Angeles municipal code and California tenant laws.

Violation of property rules may result in penalties, early termination of your stay, or forfeiture of your security deposit, to the extent permitted by California law.

6. Acceptable Use of the Website

You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, or impair our Services. You specifically agree not to:

  • Use any automated system, including bots, scrapers, or spiders, to access our Services without our prior written permission.
  • Attempt to gain unauthorized access to any part of our Services, other users' accounts, or any systems or networks connected to our Services.
  • Transmit any viruses, malware, or other harmful code through our Services.
  • Use our Services to send unsolicited commercial communications or spam.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of our Services or the servers or networks used to make our Services available.
  • Collect or harvest personal information about other users without their consent.
  • Use our Services in any manner that could constitute a criminal offense or give rise to civil liability.

7. Intellectual Property

All content on our website, including text, graphics, photographs, logos, icons, images, audio clips, software, and compilation of content, is the property of Bei Hu Properties LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Luxora Living," our logo, and other marks used on our website are trademarks of Bei Hu Properties LLC. You may not use our trademarks without our prior written consent. You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, information, or materials provided through our Services, including property listings, availability, pricing, or photographs.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA AND APPLICABLE FEDERAL LAW, IN NO EVENT SHALL BEI HU PROPERTIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00). NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bei Hu Properties LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your conduct in connection with our Services or properties.

11. California Tenant Rights

Nothing in these Terms is intended to waive, limit, or modify any rights you may have under California landlord-tenant law. As a tenant in the State of California, you are entitled to certain protections, including but not limited to:

  • Habitability: The right to a habitable dwelling that meets basic health and safety standards, as required by California Civil Code Section 1941.
  • Security deposits: Protections regarding the collection, holding, and return of security deposits under California Civil Code Sections 1950.5 through 1950.7.
  • Privacy: The right to reasonable notice before a landlord enters your unit, as required by California Civil Code Section 1954.
  • Anti-retaliation: Protection against retaliatory actions for exercising your legal rights under California Civil Code Section 1942.5.
  • Rent control and just cause eviction: If applicable, protections under the California Tenant Protection Act of 2019 (AB 1482) and any local rent stabilization ordinances, including the City of Los Angeles Rent Stabilization Ordinance.
  • Fair housing: Protection against discrimination under the California Fair Employment and Housing Act (FEHA) and federal Fair Housing Act.

12. SMS Messaging Terms and Conditions

12.1 Program Description

Luxora Living offers SMS text messaging services to provide customers with transactional notifications, including booking confirmations, property access codes, check-in/check-out instructions, and essential account updates.

12.2 Opt-In

By explicitly providing your mobile phone number and consenting through our online booking or registration forms, you authorize Luxora Living to send you automated text messages. Consent to receive text messages is not a condition of purchasing any goods or services.

12.3 Opt-Out

You can cancel the SMS service at any time. Just text "STOP" to the toll-free number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

12.4 Help and Support

If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at support@theluxoraliving.com.

12.5 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

12.6 Cost and Frequency

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your booking activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

12.7 Privacy and Data Sharing (Strictly Enforced)

We respect your privacy. Luxora Living will strictly use your phone number for internal communication regarding your services. Mobile information, including phone numbers and consent data, will not be shared with or sold to third parties, affiliates, or marketing agencies for promotional or marketing purposes.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

13.2 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at contact@theluxoraliving.com and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved without resorting to litigation.

13.3 Mediation

If informal resolution is unsuccessful, either party may propose mediation through a mutually agreed-upon mediator in Los Angeles County, California. The costs of mediation shall be shared equally between the parties unless otherwise agreed.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy and any specific terms provided during the reservation or lease process, constitute the entire agreement between you and Bei Hu Properties LLC regarding your use of our Services. These Terms supersede all prior and contemporaneous agreements, proposals, and representations, whether written or oral, regarding the subject matter herein. In the event of a conflict between these Terms and a signed lease or rental agreement, the terms of the signed agreement shall prevail.
